Nashville Drug DUI Lawyer

Drug DUI Defense. Focused on the Facts, Not a Formula.

A DUI involving drugs can involve different evidence and legal questions than an alcohol-related DUI. Prescription medications, marijuana, controlled substances, toxicology results, and observations made during a traffic stop may all become part of the allegations.

Michael Killen represents clients facing drug DUI charges in Nashville and throughout Middle Tennessee. He takes the time to understand the circumstances, examine the evidence, and explain the options available based on the individual situation.

Prescription Drugs, Marijuana, and Other Substances

Drug DUI charges can involve prescription medications, marijuana, controlled substances, over-the-counter medications, or combinations of substances.

Having a valid prescription does not automatically prevent a DUI charge if the State alleges that the medication affected a person’s ability to drive. At the same time, the fact that a medication appears in a toxicology report does not by itself explain what effect it had on the person’s ability to operate a vehicle.

The same issue can arise in marijuana DUI cases. A toxicology result may identify THC or another marijuana-related substance, but the significance of that result depends on the circumstances surrounding the alleged impairment.

Factors such as the timing of use, dosage, the substance identified, other medications or substances present, and the observations made during the investigation may all need to be considered together.

Drug Testing and Evidence of Impairment

Drug DUI cases may involve blood, urine, or other toxicology testing. Understanding what a test actually establishes can be important when evaluating the allegations.

A toxicology result can identify a substance or metabolite, but the presence of a substance is not necessarily the same question as whether that substance impaired the person’s ability to drive safely.

The circumstances surrounding the collection and testing of a sample may also matter. Depending on the facts, relevant evidence can include laboratory results, collection records, chain-of-custody information, medical or prescription records, video footage, officer observations, and other evidence from the investigation.

Because drug-related DUI allegations can involve different types of substances and testing, the evidence should be considered as a whole rather than relying on one isolated result.

Drug Recognition and Other Evidence

Law enforcement may rely on an officer’s observations or specialized drug-recognition evidence when alleging drug impairment.

The investigation may include observations of a driver’s behavior, coordination, speech, appearance, physical signs, statements, or performance during roadside testing. Video and other records may provide additional information about what occurred during the stop.

When more than one substance is involved, the situation can become even more complicated. A toxicology report may identify several medications, drugs, or metabolites, making it important to understand what each result means and how the State connects those results to the alleged impairment.

Michael Killen reviews the available evidence and the circumstances surrounding the investigation to determine what issues may need to be addressed in the defense.

Potential Consequences of a Drug DUI

A drug DUI conviction can carry criminal and other consequences under Tennessee law. The potential consequences depend on the offense, prior qualifying convictions, and the circumstances involved.

Depending on the situation, a DUI conviction can affect:

  • Driver’s license
  • Employment
  • Insurance
  • Finances
  • Criminal record
  • Court-ordered requirements

More serious circumstances can result in additional or more serious charges.

The potential consequences make it important to understand the allegations and the evidence supporting them before making decisions about how to proceed.

Experienced Drug DUI Defense Throughout Middle Tennessee

When handling a drug DUI charge, he considers the circumstances of the allegation, the available evidence, and the potential options before recommending how to proceed. The goal is to pursue the resolution that best serves the client’s interests—not to assume that every charge should be handled the same way.

In some situations, a negotiated resolution may provide the best path forward. Killen Law is prepared to pursue a plea agreement or other resolution when doing so is in the client’s best interests. In other situations, taking the matter to trial may be necessary.

Every matter is approached with the understanding that the defense must be prepared to negotiate, litigate, and present the client’s position in court when necessary. Michael is prepared and ready to take a drug DUI case to trial when it serves the best interest of the client.
