Tennessee Felony DUI Penalties

Tennessee felony DUI penalties depend in part on the number of qualifying prior DUI convictions. A fourth DUI is sentenced as a Class E felony, while fifth and sixth or subsequent DUI offenses carry higher felony classifications.

Fifth DUI

Sixth or Subsequent DUI

These are general statutory penalties and do not account for every circumstance that can affect sentencing. Additional consequences may include ignition interlock requirements, monitoring, treatment, probation, and other court-ordered conditions. The specific consequences depend on the charges and circumstances involved.

When a DUI Becomes a Felony

A fourth DUI conviction is sentenced as a felony under Tennessee law. Fifth DUI offenses are classified as Class D felonies, while sixth and subsequent DUI offenses are classified as Class C felonies.

Determining whether a current charge falls within one of these categories can require a close review of the person’s prior convictions. The dates, locations, and nature of previous offenses may affect how Tennessee law applies.

Felony charges can also arise in DUI-related situations involving serious injury or death, which may result in additional or different criminal charges. Those circumstances require their own legal analysis.

Every Felony DUI Is Different

The circumstances surrounding a felony DUI charge can vary considerably from one person to another.

Michael takes the time to understand the individual situation rather than treating every felony DUI the same way. That includes considering the current allegations, the person’s prior DUI history, the circumstances surrounding the charge, and the potential consequences involved.

The goal is to give each client a clear understanding of the issues affecting their situation and the options that are available.
